Terms and Conditions and Acceptable Use Policy (AUP)
By Smart IT Solutions, herein after referred to as “Company

  1. Acceptance of Terms
  2. By applying for permission to use the Company Services, the Customer accepts without reservation all terms & conditions set forth by the Company and the terms and conditions as per the PTA (Re-Organization) Act of 1996, PECA Ordinance 2016 & 2025, and other applicable laws. These terms may be modified or updated by the Company at any time without prior notice.
  3. This agreement is applicable on all customers who has subscribed to any service provided by Smart IT Solutions, regardless of if he signed this paper.
  4. Liability and Disclaimers
  5. The Company disclaims any liability, financial or otherwise, for any:
    • loss of data, whether caused by cyberattacks, hardware/software failure, user error, or other causes;
    • interruption, suspension, or termination of services;
    • unauthorized access, hacking, phishing, malware, ransomware, DDoS attacks, or illegal payment transfers;
    • content, accuracy, or quality of information or resources made available or transmitted through the services.
  6. In any case, the Company’s total liability shall not exceed the total amount paid by the Customer for the service, excluding any third-party fees paid to other providers.
  7. The Customer acknowledges that the Internet is inherently insecure, and the Company does not guarantee uninterrupted or secure access to its services.
  8. Service Fees and Renewals
  9. Service registration/purchase charges, monthly or yearly charges, and usage beyond agreed limits shall be deposited in advance.
  10. Service renewal notices are provided as a courtesy; the Company is not responsible for failure to renew a service or failure to notify the Customer. Unrenewed services may incur additional fees to reactivate.
  11. Expired hosting is kept for 30 days only and removed from server if not renewed before 30 days. Later renewal or re-registration will incur data/backup recovery fee in addition to service re-registration and hosting charges.
  12. Security and Access
  13. The Customer is solely responsible for safeguarding passwords, account credentials, and access to websites or servers.
  14. The customer is solely responsible to keep website software up to date to avoid any security breach or hacker’s access.
  15. Company will never request passwords via email, phone, or chat. Any communication claiming otherwise should be reported as phishing.
  16. Customer must immediately notify the Company of any suspected or actual security breach, including unauthorized access, hacking, phishing, malware, or ransomware incidents.
  17. Company may suspend or terminate services immediately if malware, illegal content, or security threats are detected on the Customer’s account, without any advance notice.
  18. Customer agrees to pay any restoration/maintenance fee charged by upstream provider.
  19. Backups
  20. Company does not provide backups for regular hosting services. Backup services are available only with an additional paid subscription for all hosting/server plans.
  21. Backups, if provided, are best-effort, taken on Sundays or instantaneous as per the subscription plan. The Company is not liable for data loss, corruption, or delays in recovery.
  22. Backup recovery or website maintenance activities may incur additional fees.
  23. Acceptable Use and Legal Compliance
  24. Any attempt to undermine, damage, or gain unauthorized access to Company servers, other customers’ accounts, or third-party systems is strictly prohibited.
  25. Customer shall not use Company services to:
  • host illegal, infringing, or harmful content;
  • send unsolicited emails (spam) or phishing attacks;
  • conduct fraudulent, unlawful, or malicious activities.
  1. Company may suspend or terminate accounts violating laws or this agreement without refund and without notice.
  2. Customer shall indemnify the Company against all claims, fines, or damages arising from violations of laws, intellectual property infringement, illegal activities, or cyberattacks originating from Customer accounts.
  3. Logs and Cooperation with Authorities
  4. Company can provide server logs for the last four weeks to law enforcement agencies if required. Sometimes logs may not be available from data center due to any reason beyond control of the company.
  5. Company can appoint its representative to represent it for mutual mediation or appear in any court of law or law enforcement agency such as police or FIA or NCCIA.
  6. Customer Declaration

By signing below, the Customer ______________________________ acknowledges and agrees:

  1. Violation of any terms, AUP, or applicable laws may result in immediate suspension or termination of services. Additional charges may apply for reinstatement.
  2. Grant of permission does not create any right, title, or interest in Company services.
  3. Customer will pay any charges for usage beyond advance payments.
  4. Customer is responsible for all password protection and website security.
  5. In case of compromise of website content or passwords, Customer accepts full responsibility for any data loss or financial loss.
  6. Customer shall not host copyright-infringing material or send unsolicited emails. Violations may result in suspension, penalties, or legal action.
  7. Regular hosting is offered on shared servers and sever IP may get blacklisted due to any other customer’s spam sending, outgoing emails may be blocked or go into spam folder or delayed. Customer agrees that it is an acceptable risk of using low-cost shared hosting service. However, Customer can purchase a dedicated server/VPS if he does not wish to be blacklisted, on which total responsibility will fall on Customer regarding IP blacklisting.
  8. Company may charge additional fees for backup recovery or maintenance activities.
  9. Passwords will never be requested by the Company via email; financial losses due to phishing or password leaks are Customer’s responsibility.
  10. Password changes or account modification require a written request from the authorized email or phone provided at service registration.
  11. Service transfer requests must be submitted via Company letterhead or written request by the owner with CNIC copy.
  12. In case of disputes among partners or heirs, the Company will only acknowledge ownership decisions from SCCI, SECP, or courts of law.
  13. Customer has read and understood all terms, notices, and instructions issued by the Company and agrees to comply fully.
  14. Security Recommendations (Mandatory)
  15. Change passwords immediately upon receipt.
  16. Use strong passwords: minimum 13 characters, including uppercase, lowercase, numbers, and symbols. No dictionary word or name should be part of password.
  17. Install and regularly update antivirus software on all devices.
  18. Use licensed software and operating systems.
  19. Install firewalls and secure email servers on Internet gateways.
  20. Maintain local backups in addition to Company-provided backups.
  21. Use secure SMTP servers for guaranteed email delivery.
  22. Always keep website hosting software up to date and properly procured/licensed.
  23. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of Pakistan. Any disputes shall be resolved through arbitration in Sialkot, Pakistan, or in the courts of competent jurisdiction in Pakistan.

We may change these terms from time to time without notice to you. Changes will apply to any subsequent orders received.
